  1. THE AGENCY

Harrogate Boutique Apartments of 125-129 Valley Drive, Harrogate, North Yorkshire HG2 0JS, 4 Spring Grove, Harrogate, HG1 2HS, Middlesmoor House, 2 Langcliffe Avenue East, Harrogate, HG2 8JD and 60 Harlow Moor Drive, Harrogate, HG2 0LE (“The Agency “) acts entirely as a booking and operating agent. It arranges bookings and reservations of accommodation on behalf of third party “Property Owners “and acts as “agent” to you the business / holiday guest (“the guest”). References in these Conditions to “we”, “our” or “us” are references to Harrogate Boutique Apartments. References to “you” or “your” are references to the person making the booking and all members of the rental party who have been notified to and accepted by us.

  1. FORMATION OF CONTRACT

A binding contract between the “Guest” and the owner of the accommodation, the “Property Owner” shall be entered into upon issue of a Booking Confirmation. The Guest is solely responsible for payment of the accommodation. The Guest is wholly responsible for compliance with the Terms and Conditions set out here-under and ensuring that any other visitors to the property adhere to the same. Occupation of the accommodation by the guest serves as acceptance of these terms and Conditions.

  1. BOOKING AND PAYMENT

Booking requests can be made via email or phone, directly to “The Agency”, a confirmation will be sent in writing (normally by email).

A 20% deposit will be charged to the credit / debit card upon reservation. The remainder will be charged to the same card one month before arrival. In the case of last minute bookings (bookings made one month or less in advance), payment will be taken in full at the time of reservation.

For longer-term stays e.g. longer than one month, a deposit equal to one months’ rent will be held as a deposit and returned after departure once the property has been fully checked. Any damage, replacements or excess cleaning required will be deducted from the held deposit. A monthly payment system can be negotiated for longer-term stays between the guest and The Agency.

The Agency reserves the right to request a held deposit from the guest where they view necessary.

  1. CHECK IN AND DEPARTURE

Check in times are between 3-6 pm, if you require check in outside of these times please discuss directly with Harrogate Boutique Apartments, a surplus charge may be levied for late check ins. Harrogate Boutique Apartments will arrange access and issue you with keys for the property. Please ensure keys are left within the property as per the instructions within each property. Lost keys will be charged at £20.00 per key (there will be a number of sets required to be replaced). Please ensure you vacate the property by 10 am on the day of departure, or a late checkout charge will apply at the rate of £30.00 per hour thereafter.

  1. ANTISOCIAL BEHAVIOUR

If you disturb other guests or neighbour’s through antisocial behaviour i.e. drunken, disorderly or threatening behaviour we reserve the right to ask you to leave the apartments immediately with no refund and a minimum disturbance fee of £250.00. If the police have to be called we will charge a minimum fee of £500.00 A minimum fee of £250.00 will be levied for setting off the fire alarm whilst drunk or disorderly.

  1. SMOKING

The apartments are strictly NON-SMOKING as it is against the law. If we suspect you have been smoking in the apartment a minimum charge of £250.00 will be levied. If the police have to be called we will charge a minimum fee of £500.00.

  1. NOISE

If you disturb other guests or neighbours at any time due to excessive noise i.e. music, shouting etc. we reserve the right to ask you to leave the apartments and a minimum fee of £250.00 will be levied. If the police have to be called we will charge a minimum fee of £500.00.

  1. HEN PARTIES / STAG PARTIES

We do not knowingly accept hen and stag parties. If you have booked through an internet site and fail to highlight in the comments section that you are a hen or stage party we reserve the right to ask you to leave the apartments and a minimum fee of £250.00 will be levied. If the police have to be called we will charge a minimum fee of £500.00.

  1. LIMITATION OF LIABILITIES

The use of accommodation and amenities, where offered, is entirely at the Guest’s own risk, and no responsibility can be accepted for injury, nor loss or damage to the Guest’s belongings. No responsibility can be accepted for loss or damage to any car or its contents or unavailability of the accommodation due to circumstances beyond our control. Neither The Agency nor the Property Owner accepts responsibility for any consequential loss as a result of the forgoing.

  1. BOOKINGS FROM MINORS

Bookings from persons under the age of 18 years cannot be accepted.

  1. WARRANTIES

The Agency does not warrant and is in no way responsible for the accuracy of any verbal information given or statements made. Images displayed on the Internet and marketing material are for indicative purposes only and may not be entirely representative of the actual accommodation.

  1. CHARGES

We reserve the right to pass on any Bank Charges in the conversion of Foreign Currency, costs for representing cheques. Cheques returned by the Bank, either to represent or to refer to drawer, will be charged at £20.00 to cover costs and inconvenience. Credit Card Payments may be made but a charge of 2.5% will be levied.

American Express Credit Cards payments will include a 3.6% surcharge for all payments.

  1. PETS

Some of our Property Owners will accept a max of one or two pets; however this must be arranged via Harrogate Boutique Apartments in advance of your arrival. There is a charge of £100.00 per pet. Please take care that pets do not damage the property and furniture, you will be required to keep them off the furniture and remove any pet hair before departure. Extra charges will be levied for excess cleaning needed due to pets or the replacement of any carpets or furniture as required. This charge will be at the rate of cost plus 20% for administration of the work.

We ask all dog Owners to observe the following rules (failure to do so may result in you being asked to leave without compensation).

  • Dogs must be under strict control at all times while in the property
  • Any fouling of lawns etc. must be cleared up without delay.
  • The owner must bring the dog’s bed or basket for sleeping in.
  • Dogs MUST NOT be left alone in the property or elsewhere at any time.
  • Dogs MUST NOT lie on beds or furnishings, and hair must be well cleared up before departing.
  • Dog owners must ensure that their pets are free from parasites and fleas before they occupy the property. Failure to do so will incur subsequent charges.

Any other type of pets in the apartments must be agreed specifically at the time of booking.

14. DAMAGE  TO THE APARTMENT

You and anyone who occupies the apartment with you agree both to keep the apartment (including all equipment, utensils, furniture etc.) clean and tidy and to leave the apartment in the same condition as you found it upon your arrival. We reserve the right to charge for additional cleaning if the property is left untidy and unclean.

You and anyone who occupies the apartment with you further agrees not to use the apartment for any commercial purpose, including without limitation, assigning or subletting it or otherwise allowing anyone to occupy it who has not previously been accepted by us.

You are responsible for taking all reasonable care of the apartment and its contents. Except in the case of normal wear and tear, you will be responsible for making good any damage or excessive cleaning to/of the apartment or its contents, which has occurred due to the negligence, wilful or accidental damage or irresponsible behavior, on the part of yourself or those occupying or entering the apartment during your stay. Such damage must be reported without delay to us. The cost of the repair or replacement must be agreed with us. We reserve the right to replace, clean or repair such items and charge costs to the credit or debit card provided. This charge will be at the rate of cost plus 20% for administration of the work. Should the condition of the apartment be such that it could not reasonably be let as luxury short term, furnished accommodation then the guest will compensate the Property Owner for loss of rental income at the same rate as their own booking, until the property is once again fit for purpose. We reserve the right to take any of the aforementioned charges from the credit / debit card provided.

  1. NUMBER OF PERSONS USING THE ACCOMMODATION

The number of persons using the accommodation (except for babies in cots where applicable) shall not exceed the maximum number stated, unless otherwise arranged. Cots shall be deemed suitable only for children of 2 years and under – Cots are only available by arrangement at the time of booking. The Property Owner is entitled to refuse admission to any persons or animals not declared/named on the Booking Form or agreed to in writing at an earlier date.

  1. ALTERATIONS TO MARKETING LITERATURE

The information contained in the marketing literature produced is believed to be accurate at the time of going to press. However, the Agency reserves the right to make minor alterations if required, and shall endeavour, where possible to inform Guests of such amendments.

  1. ACCESS

The property Owner or his representatives shall be allowed access to the accommodation at any reasonable time during occupancy, and at all times in the event of an emergency.

  1. COMPLAINTS

Whilst every care is taken to ensure complete satisfaction with your accommodation, in the unhappy event of you having cause for complaint, please contact Harrogate Boutique Apartments at the first possible opportunity so every effort can be made to rectify any issues as soon as possible. Complaints cannot be dealt with effectively once the guest has departed from the accommodation.

  1. CANCELLATION POLICY

Should you wish to cancel your booking with us, you must notify us by email as soon as possible:

The booking will be cancelled with effect from the day that the written notice of cancellation is received by us. Our cancellation charges are as follows:

Advance bookings (bookings received 30 days or more before arrival):

  • Cancellations on or within 30 days of arrival, total amount is payable and will be charged to the card used for the initial 20% payment.
  • Cancellations in advance of 30 days before arrival, a 20% cancellation fee will be levied; this will have been paid at the time of booking and is non-refundable.

Late bookings (bookings received 30 days or less before arrival)

  • These bookings will be charged at the full room rate, they will have been paid in full at the time of booking and no refund will be given.

For the avoidance of doubt, refunds will not be applicable for non-arrivals.

You are strongly advised to obtain appropriate and adequate travel and personal insurance cover as, depending on the reasons for your cancellation, you may be able to reclaim our cancellation charges from your insurance company.

Regrettably, and due to the difficulty in re-letting the apartment at short notice, any curtailment of your stay will be non-refundable.

Force majeure means unusual and unforeseen events such as war, threat of war, riot, terrorism, natural disasters, fire, technical problems or accidents with airports, ports or transport, inclement weather or governmental action. Harrogate Boutique Apartments shall have no responsibility or legal liability to compensate the client for loss of opportunity to take up the holiday.

To confirm NO refunds will be issued if you are unable to travel due to Coronavirus. Harrogate Boutique apartments will not issue refunds if you have to cancel your booking within 30 days, neither can we alter the date to the future. All bookings made after 21st March 2020 are aware of coronavirus and you take the risk of not being able to travel due to illness, lockdown or any other government measures that are taken post 21st March 2020 that affect your ability to travel.

Harrogate Boutique Apartments shall have no responsibility or legal liability to compensate the client for loss of opportunity to take up the holiday.

  1. CANCELLATION OF YOUR BOOKING BY HARROGATE BOUTIQUE APARTMENTS

In the unlikely event that problems occur and your booking has to be changed or cancelled, we will contact you either in writing, by email or by telephone to explain the circumstances of change or cancellation.

We reserve the right to amend our Terms & Conditions if the need arises, if this affects your booking we will notify you accordingly.

  1. CORONAVIRUS

Should guests choose not to travel, then please see the cancellation policy you have agreed to at the time of placing your booking.

If you are unable to travel due to travel restrictions out of your control and require a receipt for insurance claims, then we can provide that for you so that you can make a claim.

We are unable to transfer booking to different dates with 30 days of arrival as this is outside of our booking policy.

  1. AMENDMENTS

Any amendments to booking and invoices, (i.e. name, address, dates etc.) will incur a charge of £15.00 + VAT – please ensure that the main named person on the Booking Form is the person to whom the invoice is to be made.

  1. NO SECURITY OF TENURE

As the apartments are used as serviced accommodation they are exempt from security of tenure legislation. You acknowledge that you have the right to occupy the apartment for the purposes of a holiday or other short term stay and that you are not using it as your permanent address.

23. BOOKINGS FOR LONGER TERM STAYS

If you are staying in an apartment on a longer-term basis; stays of seven nights or more at any location the following additional terms apply;

You and anyone who occupies the apartment with you agree both to keep the apartment (including all equipment, utensils, furniture, cooker etc.) clean and tidy and to leave the apartment in the same condition as you found it upon your arrival. We reserve the right to charge for additional cleaning if the property is left untidy and unclean.

We can provide a weekly service clean within the apartment; our cleaners will dust, hoover, change the bedding and towels and attend to the bathroom and kitchen. Our cleaners will only be able to clean around your belongings. Please note that cleaning your dishes or emptying bins does not form part of our cleaning. Cleaning is carried out Monday-Friday between the times of 9am-3pm.

Cleaning Charges: You will be quoted for the cleaning services you request at the time of booking. If we have to do more than the normally allocated time for cleaning, either each week or at the end of your stay then the additional charges will be applied to your card at £25.00 per hour.

Holding Fee – You will be asked for a £200 holding fee for chargeable’s during your stay, which will be returned in full at the end of the stay if no deductibles.

 24. Gas and Electric Allowances

We provide Gas and electric in your apartment, this is monitored and is on an allowance basis which includes the daily standing charge and a Kwh unit allowance, these have been issues based on average usage over the last 10 years and with the timers set on programmed they should operate without additional fees. Should you be in the apartments with the heating on all day you will need to monitor your usage.

You will be provided with meter readings when you move in and these will be monitored each month during your stay, you will be able to check on these yourselves if you wish the meters are at the front and side of the building.

*Gas and electric prices vary through the year and overage will be charged as the same price we have paid for that period, the allowance is based on usage not price, usage is not carried over to other months.

We reserve the right to charge for any additional Gas or Electricity used: Gas and electric accounts maybe transferred into the occupier’s name to pay directly, subject to changes made by energy providers this will be communicated, for e.g potentially the residential occupier get better prices directly with suppliers, changes to commercials contract rules or if the tenant’s overage is being billed.
